2.Use of the Website
This Legal Notice (hereinafter, “Legal Notice”) establishes the conditions that regulate the use of the information society services that GUESTIN makes available to users through the Web.

4.Intellectual and Industrial Property

The use of the Web by the User in no way implies the transfer of any intellectual and/or industrial property right over the Web, its contents and/or GUESTIN’s distinctive signs.To this effect, through this Legal Notice, except in cases where it is legally permitted, the User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting and/or reusing the Web, its contents and/or GUESTIN’s distinctive signs.The reproduction of elements or contents of the Web for profit or commercial purposes is expressly and strictly prohibited.
5. Limitation of Liability
The User acknowledges and accepts that the use of the Web is carried out at all times under their own risk and responsibility, therefore GUESTIN is not responsible for misuse or improper use that may be made of the Web. To this effect, it will only be responsible for damages that the User may suffer from the use of the Web when such damages are due to our willful misconduct.
In particular, GUESTIN will not be responsible for:
- The content of sites linked through links included within the Web. In this regard, the terms set out in section 6 of this Legal Notice will apply.
- Any type of damage caused to the User’s computer equipment by viruses, worms, trojans or any other harmful element. The User acknowledges that the use of the Internet network involves assuming a risk that their computer equipment may be affected by the elements mentioned above. To this effect, it is the User’s responsibility, in any case, to have appropriate tools available for the detection and elimination of harmful electronic programs.
- Any type of damage caused to the User resulting from failures or disconnections in telecommunications networks that cause suspension, cancellation or interruption of the Web service. In this regard, the User acknowledges that access to the Web requires services provided by third parties beyond GUESTIN’s control (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation are not GUESTIN’s responsibility.

The Website includes or may include links that allow the User to access other Internet pages and portals (hereinafter, “Links”). In these cases, GUESTIN acts as an intermediary service provider in accordance with Article 17 of the LSSI, and will only be responsible for the contents and services provided on the Linked Sites to the extent that it has effective knowledge of the illegality and has not deactivated the link with due diligence. In the event that the User considers that there is a Link with illicit or inappropriate content, we ask you to communicate it to GUESTIN through assistme@guestin.io. In no case will this communication entail the obligation to remove the corresponding link.
The existence of Links in no way implies that GUESTIN has effective knowledge or any other type of knowledge of the services and contents of these in case of illegality, nor that it necessarily maintains agreements with those responsible for or owners of the Links. Nor does the existence of such Links imply recommendation, promotion, identification or conformity of GUESTIN with the statements, contents or services provided through the Links. Consequently, GUESTIN is not responsible for the content of the Links, nor for their conditions of use and privacy policies, with the User being solely responsible for checking and accepting them each time they access and use them.The User and, in general, any natural or legal person who intends to establish a link from their page or site to the Web, must obtain prior written authorization from GUESTIN. 8. Applicable Legislation and Competent Courts
The use of the Web is governed and interpreted in accordance with Spanish Law and it is understood that, by using the Website, the User agrees that any conflict or litigation that arises between the user and GUESTIN will be dealt with, expressly waiving their jurisdiction, by the Courts and Tribunals of Barcelona capital except in the case that the user is a consumer, which will be subject to the provisions of consumer and user regulations.
In the event that any of the provisions contained in this Legal Notice is declared null, it will be withdrawn or replaced. In any case, such declaration of nullity will not affect the validity of the rest of the provisions contained in this Legal Notice.
